DECREE OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE
NUMBER KEP-51/BC/2011

CONCERNING
DELEGATION OF AUTHORITY TO DIRECTOR OF CUSTOMS TECHNICAL, DIRECTOR OF CUSTOMS FACILITATION, DIRECTOR OF REVENUES AND REGULATIONS OF CUSTOMS AND EXCISE, HEAD OF MAIN SERVICE OFFICE OF CUSTOMS AND EXCISE, AND HEAD OF CUSTOMS AND EXCISE SUPERVISION AND SERVICE OFFICE, FOR AND ON BEHALF OF THE MINISTER TO MAKE AND SIGN DECREE CONCERNING GIVING THE PERMIT TO USE GUARANTEE IN THE FRAMEWORK OF CUSTOMS

DIRECTOR GENERAL OF CUSTOMS AND EXCISE,

Considering:

a. that the Regulation of the Minister of Finance Number 184/PMK.01/2010 concerning Organization and Working Procedure of Ministry of Finance, said that the Directorate of Customs Technical performs the functions in the preparation of the policy implementation in the field of customs technical;

b. that the Regulation of the Minister of Finance Number 184/PMK.01/2010 concerning Organization and Working Procedure of Ministry of Finance, said that the Directorate of Customs Facilitation performs the functions in the preparation of the policy implementation in the field of customs facilitation;

c. that the Regulation of the Minister of Finance Number 184/PMK.01/2010 concerning Organization and Working Procedure of Ministry of Finance, said that the Directorate of Revenues and Regulations of Customs and Excise performs the functions in the preparation of the policy implementation in the field of Revenues and Regulations of customs and excise;

d. that the Regulation of the Minister of Finance Number 74/PMK.01/2009 concerning Organization and Working Procedure of Vertical Agencies of Directorate General of Customs and Excise as amended by Regulation of the Minister of Finance Number 134/PMK.01/2010, said that Head of Main Service Office performs the functions of the implementation of licensing and facilitation service in the field of customs and excise;

e. that the Regulation of the Minister of Finance Number 74/PMK.01/2009 concerning Organization and Working Procedure of Vertical Agencies of Directorate General of Customs and Excise as amended by Regulation of the Minister of Finance Number 134/PMK.01/2010, said that the Customs and Excise Supervision and Service Office perform the functions of the implementation in giving licensing and facilitation in the field of customs and excise;

f. that based on the considerations as intended in paragraphs a, b, c, d and e it is necessary to delegate authority of the Director General of Customs and Excise to the Director of Customs Technical, Director of Customs Facilitation, Director of Revenues and Regulations of Customs and Excise, Head of Main Service Office of Customs and Excise, Head of Customs and Excise Supervision and Service Office, for and on behalf of the Minister make and sign a Decree concerning Giving the Permit to Use Guarantee in the Framework of Customs;

In view of:

1. Law Number 10 of 1995 concerning Customs (Statute Book of the Republic of Indonesia Number 75 of 1995, Supplement to Statute Book of the Republic of Indonesia Number 3612) as amended by Law Number 17 of 2006 (Statute Book of the Republic of Indonesia Number 93 of 2006, Supplement to Statute Book of the Republic of Indonesia Number 4661);

2. Regulation of the President of the Republic of Indonesia Number 95 of 2006 concerning Organization and Working Procedure of Vertical Agencies within Ministry of Finance Environment as amended by Regulation of the President of the Republic of Indonesia Number 22 of 2007;

3. Regulation of the Minister of Finance Number 184/PMK.01/2010 concerning Organization and Working Procedure of Ministry of Finance;

4. Regulation of the Minister of Finance Number 74/PMK.01/2009 concerning Organization and Working Procedure of Vertical Agencies of Directorate General of Customs and Excise as amended by Regulation of the Minister of Finance Number 134/PMK.01/2010;

5. Regulation of the Minister of Finance Number 259/PMK.04/2010 concerning Guarantee in the Framework of Customs;

6. Regulation of the Director General of Customs and Excise Number PER-2/BC/2011 concerning Management of Guarantees in the Framework of Customs;

DECIDES:

To stipulate:

REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE CONCERNING DELEGATION OF AUTHORITY TO DIRECTOR OF CUSTOMS TECHNICAL, DIRECTOR OF CUSTOMS FACILITATION, DIRECTOR OF REVENUES AND REGULATIONS OF CUSTOMS AND EXCISE, HEAD OF MAIN SERVICE OFFICE OF CUSTOMS AND EXCISE, AND HEAD OF CUSTOMS AND EXCISE SUPERVISION AND SERVICE OFFICE, FOR AND ON BEHALF OF THE MINISTER TO MAKE AND SIGN DECREE CONCERNING GIVING THE PERMIT TO USE GUARANTEE IN THE FRAMEWORK OF CUSTOMS.

FIRST:

To delegate the authority to:

• a. Director of Customs Technical, in case of approval to use Corporate Guarantee to the entrepreneurs who got facilitation issued by Directorate of Customs Technical because they have fulfilled determined requirements to get special services in the field of customs;
• b. Director of Customs Facilitation, in case of approval to use Corporate Guarantee to the entrepreneurs who got facilitation issued by Directorate of Customs Facilitation because they have fulfilled determined requirements to get special services in the field of customs;
• c. Director of Revenues and Regulations of Customs and Excise, in case of approval to use Corporate Guarantee to the entrepreneurs who got facilitation issued by Directorate of Revenues and Regulations of Customs and Excise because they have fulfilled determined requirements to get special services in the field of customs;
• d. Head of Main Service Offices of Customs and Excise, in case of the giving permit to use written Guarantee in the Main Service Offices of Customs and Excise; and
• e. Head of Customs and Excise Supervision and Service Offices, in case of the giving permit to use written Guarantee in Customs and Excise Supervision and Service Offices,
• for and on behalf of the Minister to make and sign Decree concerning Giving the permit to use guarantee in the framework of customs.

SECOND:

Director of Customs Technical, Director of Customs Facilitation, Director of Revenues and Regulations of Customs and Excise, Head of Main Service Office of Customs and Excise, Head of Customs and Excise Supervision and Service Office must report the implementation of authority as intended in the FIRST dictum periodically to the Director General of Customs and Excise.

THIRD:

If in further there is any mistake in this Decree of the Director General of Customs and Excise it will be amended as appropriate.

FOURTH:

This Decree of the Director General of Customs and Excise shall come into force on the date of stipulation.

Copies of this Decree of the Director General of Customs and Excise are submitted to:

• 1. Secretary of Directorate General of Customs and Excise, the Directors, Head of Internal Obedient Center, and the Reviewers, within the Directorate General of Customs and Excise;
• 2. The Head of Regional Offices of the Directorate General of Customs and Excise; and
• 3. The Head of the Main Service Offices of Customs and Excise and the Head of Supervision and Service Offices of Customs and Excise within Directorate General of Customs and Excise environment.
